Minutes of the regular Meeting of Council of the Rural Municipality of Rosedale held on the above date in the Municipal Office, Neepawa, with the following members present: Reeve Bill Martin, Councillors Ernie Schure – Ward 1, Robert Scott – Ward 2, Steve Pegoski – Ward 3, Ron Kostenchuk – Ward 4, Michael Porrok – Ward 5, Duane Stewart – Ward 6

That this regular meeting of Council convenes at 10:00 a.m. with Reeve Bill Martin as chairman.
17/173 Kostenchuk – Stewart
That Be It Resolved that the Council of the R. M. of Rosedale approves the Agenda for October 13, 2017.
17/174 Scott -Porrok
That the minutes of the regular meeting held September 8, 2017 be adopted as circulated.

That we adopt the September, 2017 financial statements.

That Council approves the accounts for the month and amounts as follows:
September 2017 $133,492.61 $1,686.17

Whereas the proposed subdivision request by Robert J. McConnell on MW 12-17-15 WPM was presented to Council on Friday, October 13, 2017;
Now Therefore the Council of the R. M. of Rosedale approve the proposed subdivision by Robert J. McConnell on the NW 12-17-15W providing the following conditions are met:
1) That a Conditional Use Order be granted allowing for the location of the rural non-farm single-family dwellings within the “AG 80” Zone.

Whereas the proposed subdivision request by Robert and Betty Bold and the Rural Municipality of Rosedale on SE 04-16-15 WPM was presented to Council on Friday, October 13, 2017
Now Therefore the Council of the R. M. of Rosedale approve the proposed subdivision by Robert and Betty Bold and the Rural Municipality of Rosedale on SE 04-16-15 WPM providing the following condition is met:
1) That a Variation Order be granted reducing the minimum site area from 0.5 acres to 0.23 acres in the “AG 80” Sone.
17/179 Porrok – Schure
Whereas the proposed subdivision request by John Janzen and Jason Bartel on SW 34-17-15WPM was presented to Council on Friday, October 13, 2017;
Now Therefore the Council of the R. M. of the Rosedale approve the proposed subdivision by John Janzen and Jason Bartel on SW 34-17-15 WPM providing the following conditions are met:
1- That a conditional use be granted for the non-farm single-family dwelling within the AG-80 Zone
2- That a conditional use be granted for the Small Scale Industry being the saw mill within the AG-80 Zone
3-That a variation be granted reducing the minimum required Agriculture parcel of 80 acres be reduced to +/-33.23 acres for the proposed livestock operation being the chicken barns within the AG-80 Zone
4- That a variation be granted reducing the required setback from 2625’ to 1980’ for an animal housing facility or earthen manure facility to a residence for the neighboring pig operation within the AG-80 Zone

That we the Council of the R. M. of Rosedale agree to grant $300.00 in support of the 2017 Parade of Lights.
17/181 Stewart – Scott
That Be It Resolved that the Council of the R. M. of Rosedale agrees to allow the trenching of hydro under Municipal Road #88W between NE 17-19-15W and SE 15-19-15W (20 Mountain Avenue) yard sites provided the following conditions are met:
1- That all cost and repairs associated with this crossing; including long term repair of the road in the event that the cut settles and /or causes ruts or pot holes in the future, will be the responsibility of Geoffrey Burton
2-That if any buildings are being constructed for this project, they will require permits and comply with setbacks as per all Neepawa and Area Planning District requirements

That we the Council of the R. M. of Rosedale accept the list of deletions to the tax roll as provided by the Municipal Assessment Branch.
17/183 Kostenchuk – Stewart
That we the Council of the R. M. of Rosedale accept the list of additions with Section 326 of the Municipal Act and direct the CAO to issue the necessary tax notices.
17/184 Kostenchuk – Pegoski
That the 2017 tax sale be held at 10:30a.m. at the R. M. of Rosedale Council Chambers on March 9, 2018
17/185 Stewart – Scott
That any member of Council and the CAO be authorized to attend the 2017 AMM Convention from November 27 to 29, 2017and that allowable expenses be paid.
And furthermore that each receives $120 per day for meals and hourly.

That we agree to pay our remaining 2017 levy in the amount of $12,631.63 to Whitemud Watershed.
17/187 Scott – Porrok
That we the Council of the R. M. of Rosedale agree to grant $150.00 from VLT funds to the Eden Fire Hall in support of the 2017 Pancake Breakfast fundraiser.
Wards 2 and 5 – $75.00
17/188 Stewart – Scott
That we agree to purchase a wreath in the amount of $100 from the Royal Canadian Legion for Remembrance Day.

That we agree to pay the Neepawa Banner $51 for advertising in the 2017 Remembrance Day Feature.
17/190 Kostenchuk – Pegoski
That Be it Resolved that we purchase ¼ page for the amount of $295.00 towards the Royal Canadian Legion in 2017.
17/191 That we the Council of the R. M. of Rosedale has agreed to grant Muscular Dystrophy Canada $250.00 to assist with public knowledge of neuromuscular disorder as well as educate the public about the organization.
17/192 Stewart – Porrok
That we agree to pay Carol Bray $1000.00 for supplies and her assistance in recording the Kelwood and Riding Mountain Cemetery historical information.
17/193 Porrok – Pegoski
That we the Council of the R. M. of Rosedale agree to grant Carol Bray $500.00 for her assistance in recording the Birnie Cemetery information.
17/194 Pegoski – Schure
That we the Council of the R. M. of Rosedale agree to grant the Canada Post Community Foundation $75.00 in support of the 2017 campaign objective to provide local education, community projects & health initiatives.
Wards 1, 2, and 5 – $25.00.
17/195 Kostenchuk – Scott
We agree to grant the Neepawa Area Health Auxiliary $1500.00 in support or the 2016 & 2017 Fall Canvass for donations.

That By-law 2-2017 being a by-law for the purpose of authorizing appointments and remuneration of the Municipal Officials with the adjustments of Councilor indemnity being increased to $650.00 per regular meeting and Reeve indemnity increased to $700.00 per regular meeting be read a first time.

That we the Council of the R. M. of Rosedale agrees to charge $200.00 per cemetery plot at the:
Birnie Cemetery, Kelwood Cemetery, Riding Mountain Cemetery and Rosedale Cemetery as of January 1, 2018

That we the Council of the R. M. of Rosedale authorize the CAO and Reeve to sign the offer for extension of the 2015-2017 R. M. Gravel Road Maintenance Agreement (Jan. 1, 2018-Dec. 31, 2018)

That we the Council of the R. M. of Rosedale agree to grant $4,600 to the Kelwood Fire Department for the installation of a cement pad and enclosure of breezeway on the Kelwood Fire Hall.
17/200 Stewart – Scott
Whereas the Rural Municipality of Rosedale 2016 audited financial statement indicates that the Kelwood Water Utility incurred an operating deficit with and excess of expenses over revenues of $723.00 in 2016;
And Whereas the Rural Municipality of Rosedale 2016 audited statement indicates the 2016 end nominal surplus of $208,499.00;
Therefore Be It Resolved that the Rural Municipality of Rosedale request authorization from the Public Utility Board for the 2016 audited operating deficit of $723.00 incurred by the Kelwood Water Utility to be absorbed into the Kelwood Water Utility Nominal Surplus therefore reducing the surplus accordingly.

That By-law 3-2017 being a by-law to provide for water rates in the Local Urban District of Kelwood and the Collection therefore now be read a first time.

That By-law 4-2017 being a by-law to authorize the RM of Rosedale to enter into an agreement with the Town of Neepawa for the supply of water to the Municipality be read a third time, passed signed and sealed.
