Minutes of the regular Meeting of Council of the Rural Municipality of Rosedale held on the above date in the Municipal Office, Neepawa, with the following members present: Reeve Bill Martin, Councillors Ernie Schure – Ward 1, Robert Scott – Ward 2, Steve Pegoski – Ward 3, Ron Kostenchuk – Ward 4, Michael Porrok – Ward 5, Duane Stewart – Ward 6

That the minutes of the regular meeting held September 11, 2015 be adopted as circulated.

That we do now adjourn this regular meeting at 10:30 a.m. to hold a public hearing regarding Lots 15 and part of 16, Plan 356 in the Village of Kelwood.

That the Public Hearing be now open at 10:30 a.m. for amendment to Rural Municipality of Rosedale By-Law No. 5-88 from Agricultural Livestock Restricted Zone to General Development Zone.

That we agree to pay $100 to the Riding Mountain Regional Liaison Committee for the Riding Mountain Biosphere Reserve 2015 membership dues.

That we agree to provide payment of $295 to the MB/NW Ontario Command of the Royal Canadian Legion for artwork in the 2015 Remembrance Book.

That we agree to pay the Neepawa Banner $49 for advertising in the 2015 Remembrance Day Feature.

That Whereas a hearing was held on Friday, November 13th, 2015. to hear representations for or against the proposed Conditional Use Order Request by George & Rhonda Friesen NE 33-17-15WPM.
Whereas there was no representations for or against the proposed Conditional Use Order request.
Now therefore the Council of the Rural Municipality of Rosedale approve the Conditional Use Request to allow for the location of a non-farm single-family site within the “AG-80” Agricultural General Zone providing the following conditions are met:
That a Development Agreement be entered into including the following:
- a) any construction requires a development/building permit before work starts;
- b) the new site is to be serviced by a holding tank or an a approved Manitoba Environment waste disposal system;
- c) that the existing infrastructure remain unchanged;
- d) that any new or improved access that is required to the property will be the responsibility and cost of the owner and is to be approved by the Municipality;
- e) that any survey monuments that are disturbed must be replaced in compliance with The Survey Act at the owners’ expense;
- f) the number of animals at any given time on the parcel is restricted to 2 animal units;
- g) that any present of future owner be aware of the problem from Livestock (odours, noise, dust, etc. and future expansion) and further hold the Municipality blameless with respect to any Agricultural land that may be a nuisance to the landowners;
- h) if any conditions of the Conditional Use is not complied with, the Conditional Use may be revoked;

That we agree to purchase a wreath in the amount of $100 from the Royal Canadian Legion for Remembrance Day.

That any member of Council and the CAO be authorized to attend the Municipal Convention November 23 to 25, 2015 and that allowable expenses be paid.
And furthermore that each receive $120 per day for meals and hourly.
15/208 Pegoski – Kostenchuk
That we agree to accept Ken Beatty Construction Ltd. Tender of $3.10 per yard to crush 10,000 yards of gravel at Eden gravel pit, 15,000 yards of gravel at Elk Ranch gravel pit and 20,000 yards of gravel at Fisher gravel pit to be done in 2015.

That we agree to sell Lot 15 and 16 of Block 4, Plan 428 in the Village of Kelwood to Allan and Shirley Potter for $525.00 plus all legal and transfer costs.

That we agree to pay W & K Loewen a final payment of $10,924.84 for the mechanical ventilation installed in the Eden Fire Hall.

That we agree to grant the Birnie Nursery School $2,000 from VLT funding.

That we authorize Kara Sylvester, CAO to register for the Certificate in Manitoba Municipal Administration (CMMA) course and that all allowable expenses be reimbursed upon passing and completion of each level as required.

That we agree to provide $299 for the registration for and any other expenses required to Kara Sylvester, CAO to attend the MMAA course scheduled December 10 and 11, 2015 in Winnipeg, MB.

That we agree to provide $1500.00 to Westlake Employment Skills and Services Centre for funding for the year 2015.

That By-law 8-2015 being a by-law for the purpose of authorizing appointments and remuneration of the Municipal Officials be read a first time.
