Minutes of the regular Meeting of Council of the Rural Municipality of Rosedale held on the above date in the Municipal Office, Neepawa, with the following members present: Reeve Bill Martin, Councillors Ernie Schure – Ward 1, Robert Scott – Ward 2, Steve Pegoski – Ward 3, Ron Kostenchuk – Ward 4, Michael Porrok – Ward 5, Duane Stewart – Ward 6

18/103      Stewart – Scott

That this regular meeting of Council convene at 10:00 a.m. with Reeve Bill Martin as chairman.


18/104      Pegoski – Kostenchuk

That Be It Resolved that the Council of the R. M. of Rosedale approves the Agenda for May 11, 2018.


18/105      Pegoski – Porrok

That the minutes of the regular meeting held April 13, 2018 be adopted as circulated.


18/106      Kostenchuk – Pegoski

That Council approves the accounts for the month and amounts as follows:

18/107      Scott – Porrok

We agree to adopt the April 2018 financial statements.


18/108      Scott – Schure

WHEREAS the proposed subdivision request by Robert and Catherine Smith on NW 34-15-15WPM was presented to Council on Friday, May 11, 2018;

NOW THEREFORE the Council of the R. M. of Rosedale approve the proposed subdivision by Robert and Catherine Smith on the NW 34-15-15W providing the following conditions are met:

1) THAT a Conditional Use Order be granted allowing for the non-farm single-family dwellings within the”AG80” Zone.

2) THAT a Variation Order be granted increasing the maximum site area from 10 acres to 17.9 acres and reducing the site width from 200’ to 159’.

That we the Council of the R. M. of Rosedale agree to adopt the Drug & Alcohol Free Workplace Policy.


18/110      Stewart – Schure

That By-law 5-2018 for the prevention and control of wildland fires within the Rural Municipality of Rosedale now be read a first time.


18/111      Kostenchuk – Pegoski

That By-law 5-2018 be read a second time.


18/112      Porrok – Schure

That we authorize the CAO and Council to attend the June District Meeting on Friday, June 15, 2018 at the Neepawa United Church and that allowable expenses be paid.


18/113      Porrok – Pegoski

THAT WHEREAS Section 10(1) of the Municipal Councils and School Board Elections Act requires each municipality to appoint a senior election official (SEO) who will be responsible to manage and conduct all aspects of municipal elections;

NOW THEREFORE BE IT RESOLVED that Kara Sylvester is hereby appointed to the position of SEO for the R. M. of Rosedale.


18/114      Scott – Stewart

WHEREAS a municipal election is to be held on October 24, 2018 to elect a Head of Council and six Councillors for the Rural Municipality of Rosedale;

AND WHEREAS the municipality is required to establish a rate of remuneration for the Election Officials;

THEREFORE BE IT RESOLVED THAT the R. M. of Rosedale pay Election Officials $15.00 per hour plus mileage for the 2018 Municipal Election.


18/115      Schure – Porrok

That we the Council agree to authorize Reeve and CAO to sign the Easement Agreement between the Hutterian Broadband Network Inc. and the Rural Municipality of Rosedale to allow the installation of fiber optic cable alongside roadways in municipal ditches.


18/116      Pegoski – Kostenchuk

That we the Council of the RM of Rosedale authorize Kara Sylvester or Colleen McLaughlin to attend the Municipal Elections Training Workshop scheduled to take place in Brandon, Manitoba on June 22, 2018 and that allowable expenses are paid.


18/117      Schure – Scott

That we do now adjourn our regular meeting at 1:30 p.m. to hold a public hearing regarding our 2018 Financial Plan.

That the Public Hearing now be open at 1:30 p.m.


18/119      Stewart – Schure

That we do now adjourn the public hearing regarding the 2018 Financial Plan at 1:40 p.m. to reconvene for our regular meeting.


18/120      Scott – Kostenchuk

Whereas Section 162(1) of the Municipal Act requires every Council adopt a financial plan each fiscal year;

And Whereas By-law 4-2018 has been drawn up for the levying of taxes for the current year;

Now Therefore Be It Resolved that By-law 4-2018 now be read a first time.


18/121      Pegoski – Porrok

That we adopt the R. M. of Rosedale’s 5 Year Capital Expenditure Program as required under Section 167 of the Municipal Act.


18/122      Stewart – Scott

That we the Council of the Rural Municipality of Rosedale agree to hire Robert Burton as our part-time operator for the supply and treatment system located in the Village of Kelwood effective May 11, 2018 for $15.00 per hour.


18/123      Scott – Stewart

That we the Council agree to reimburse Penno’s Machining and Manufacturing Limited for the overbilling of their utility invoices by the municipality since June 2015 in the amount of $4,640.35.


18/124      Pegoski – Porrok

That we the Council of the RM of Rosedale we the Council agree to schedule a public hearing for the first reading of the amending by-law of the Local Improvement Plan on June 8, 2018 at 1:30 p.m.
