Minutes of the regular Meeting of Council of the Rural Municipality of Rosedale held on the above date in the Municipal Office, Neepawa, with the following members present: Reeve Bill Martin, Councillors Ernie Schure – Ward 1, Robert Scott – Ward 2, Steve Pegoski – Ward 3, Ron Kostenchuk – Ward 4, Michael Porrok – Ward 5, Duane Stewart – Ward 6

That this regular meeting of Council convene at 10:00 a.m. with Reeve Bill Martin as chairman.

That the minutes of the regular meeting held January 8, 2016 and the special meeting held January 13, 2016 be adopted as circulated.

That Be It Resolved that the Council of the R. M. of Rosedale approve the Agenda for February 12, 2016.

That the Council approves the accounts for the month and amounts as follows:

That we adopt the December 2015 financial statements.

That we adopt the January 2016 financial statements.

That we authorize Kara Sylvester, CAO to attend the CMMA Tutorials to be held in Brandon February 18 and March 16, 2016 and that all allowable expenses be paid.

That we the Council of the R. M. of Rosedale agree to pay Kara Sylvester’s 2016 MMAA Membership dues of $245.

That we do now adjourn this regular meeting at 10:15 a.m. to hold a public meeting regarding Christopher and Sharon Kulbacki Conditional Use Hearing on NW 1-16-16W.

That we the Council of the Rural Municipality of Rosedale would like to re-enter into a Memorandum of Understanding (MOU) agreement with the Manitoba Water Services Board respecting the operation and maintenance of Kelwood and Eden Treatment Plants.

That We the Council of the Rural Municipality of Rosedale request Transportation and Government Services for 10% grant of annual value of the gravel road initiative agreement.
16/41 Porrok – Kostenchuk
That we the Council of the R. M. of Rosedale accept the following tender to purchase a stockpile of crushed gravel for 2016 Ken Beatty Construction Ltd. 2,000 – 3,000 yards of Crushed Gravel – $3.60 per yard.

Whereas the Town of Neepawa, the RM of Rosedale, the former RM of Langford, the former RM of Lansdowne and the former RM of Glenella met on August 6, 2014 to proceed with binding arbitration regarding tax sharing of the ambulance facility
And whereas prior to the commencement of the arbitration hearing, the Town of Neepawa made an offer to the municipalities to retroactively share the taxes on the ambulance facility
And whereas the Town of Neepawa also made an offer to purchase the road Veterans Way back from the four municipalities at original cost less depreciation of eight years over either a five or ten year period
And whereas due to elections and amalgamations, this issue has not yet been resolved
Therefore be it resolved the Council of the R. M. of Rosedale accept the Town of Neepawa’s offer to retroactively share the taxes on the ambulance facility and therefore not proceed with the binding arbitration
And also be it resolved the Council of R. M. of Rosedale agree to sell control and ownership of the road Veterans Way to the Town of Neepawa at the original (non-depreciated) cost of the road over either a five or ten year period.
16/43 Pegoski – Porrok
WHEREAS Section 165(1) of The Municipal Act requires that a municipality must obtain written approval from the Minister for a deficit incurred by the General Operating Fund;
AND WHEREAS the Municipality of Rosedale incurred an operating deficit of $142,894 as per the 2015 Audited Financial Statements due to higher than budgeted expenditures;
THEREFORE BE IT RESOLVED that the Council of the Municipality of Rosedale request permission from the Minister for the General Operating Fund Deficit of $142,894 incurred by the Municipality of Rosedale;
AND FURTHER BE IT RESOLVED that the Council of the Municipality of Rosedale request approval to recover the deficit by reducing the surplus accordingly
16/44 Kostenchuk – Pegoski
That we agree to grant the HAND Committee $894.85 which represents 55 cents per capita for 2016 for their programs.
16/45 Stewart – Scott
That the Council of the R.M. of Rosedale approve an in-kind donation in the equivalent amount of $1,500 to The Harvest Sun Music Festival in the form of water usage, lawn maintenance (as required) and the loaning of snow fence for use during the 2016 festival.
16/46 Porrok – Schure
That we the Council of the R. M. of Rosedale grant the Birnie Community Club $2000.00 from VLT.

That we the Council of the R. M. of Rosedale agree to grant the Manitoba Crime Stoppers Association $162.70 to help defray the web site and office costs for 2016.

That we the Council of the R. M. of Rosedale grant the Riding Mountain Curling Club $1,000 from VLT funds.

That we the Council of the R. M. of Rosedale grant the Kelwood Skating Club $1,500 from VLT funds.

That we the Council of the R. M. of Rosedale agree to grant the Neepawa Area Collegiate Institute $500 to provide the Rosedale Centennial Scholarship to a graduating student in 2016.
16/51 Stewart – Scott
That we the Council of the R. M. of Rosedale agree to grant the Neepawa and Area Silver Spurs 4H Club $100.00 to help assist with the costs of the horsemanship clinics to be held in 2016.

That we the Council of the R. M. of Rosedale agree to pledge a donation of $125.00 for the 2016 Neepawa Fire Hall – Mustache Growing Fundraiser (Kyle Kostenchuk)

That we the Council of the R. M. of Rosedale agree to grant the Neepawa Junior Rifle Club $1500.00 to assist with the costs to upgrade the buildings existing light fixtures in 2016.

That we the Council of the R. M. of Rosedale agree to approve Kelsey Robinson’s request to carry forward 78 hours of vacation time from 2015 to 2016 as per the Union Agreement Article 7 – Section 7.05(a)
Prior to May 1st each year, each employee shall provide the Municipality with a written request concerning the employee’s proposed vacation during the months of June, July or August.
