Minutes of the Special Meeting of Council of the Rural Municipality of Rosedale held on the above date in the Municipal Office, Neepawa, with the following members present: Reeve Bill Martin, Councillors Ernie Schure – Ward 1, Robert Scott – Ward 2, Steve Pegoski – Ward 3, Ron Kostenchuk – Ward 4, Michael Porrok – Ward 5, Duane Stewart – Ward 6

17/17        Pegoski – Porrok

That this special meeting of Council convene at 10:00 a.m. with Reeve Bill Martin as chairman.

17/18        Stewart – Scott

That we do now adjourn this special meeting at 10:00 am to hold a Public Hearing regarding Bonney Bradshaw Variation Order and Conditional Use requests on NW 21-18-15W.

17/19        Pegoski – Schure

That the Public Hearing be now open at 10:00 am for the Bonny Bradshaw Variation Order and Conditional Use Hearing.

That the Public Hearing be now closed at 10:30 am to reconvene for our special meeting.

17/21        Porrok – Schure

That whereas a hearing was held on Wednesday, February 1st, 2017 to hear representation for or against the proposed Conditional Use request by Rob Van Kommer/Tri-wave Construction Ltd./Bonney Bradshaw NW-21-18-15-W;

Whereas there was representation for or against the proposed Conditional Use request;

Now therefore, the Council of the Rural Municipality of Rosedale approves the Conditional Use request to allow for the location of a Gravel Extraction Operation within the “AG-80” Agricultural General Zone providing the following conditions are met:

1- All current and future operations sign a road haul agreement with the RM of Rosedale

2- All current and future operations must provide dust control to Councils Satisfaction

3- The Top of road rehabilitation shall be maintained at the discretion of Council during times of Hauling.

4- All current and future operations must register any extraction operation and must rehabilitate the area to the appropriate Provincial Department standards.

5- Any current and future operations organize equipment in a manner which will not pose a nuisance to neighboring land owners in relation to Noise, Dust or lights.

6- Use of engine retarder brakes are prohibited.

That Whereas a hearing was held to hear representation for or against the proposed Variation Order request by Rob Van Kommer / Tri-wave Construction Ltd. NW-21-18-15-W;

And Whereas there was representation for or against

Now Therefore the Council of the R. M. of Rosedale approve the proposed Variation Order to allow the minimum required setback of 125 feet from the North Property Boundary when adjacent to a Municipal road be reduced to 50 Feet providing the following condition is met:

1) That any new or improved access that is required to the property will be the responsibility and cost of the owner and is to be approved by the municipality.

That we authorize Colleen McLaughlin to attend the Employment Standards workshop in Brandon, Manitoba and that allowable expenses be paid.
