Minutes of the regular Meeting of Council of the Rural Municipality of Rosedale held on the above date in the Municipal Office, Neepawa, with the following members present: Reeve Bill Martin, Councillors Robert Scott – Ward 2, Steve Pegoski – Ward 3, Ron Kostenchuk – Ward 4, Michael Porrok – Ward 5, Duane Stewart – Ward 6
Absent: Ernie Schure – Ward 1

That this regular meeting of Council convene at 10:00 a.m. with Reeve Bill Martin as chairman.

That Be It Resolved that the Council of the R. M. of Rosedale approve the agenda for August 12, 2016.

That the minutes of the regular meeting held July 8, 2016 be adopted as circulated.

That we adopt the July 2016 financial statements.

That the Council approves the accounts for the month and amounts as follows:
July 2016 $125,422.91 $2,037.43
16/172 Kostenchuk – Stewart
That the Council of the Rural Municipality of Rosedale has agreed to grant Muscular Dystrophy Canada $250.00 to assist with public knowledge of neuromuscular disorders as well as educate the public about the organization.

16/173 Kostenchuk – Pegoski
That Whereas a hearing was held on Friday, June 10, 2016 to hear representation for or against the proposed Conditional Use Request by Rodney and Roxanne Wagler on Lot 1, Plan 38731, NW 21-16-16W;
Now therefore, the Council of the Rural Municipality of Rosedale approve the Variation Order request to allow for the location of a Home Occupation outside of a residence, being repair and sales of automobiles within the “RR2” Residential Rural Zone providing the following conditions are met:
- a) The existing building shall be equipped with carbon monoxide detector
- b) A ceiling fan shall be controlled directly from a light switch operating the lights in that area
- c) All fuel fired equipment shall be housed in a service room with a minimum 1 hour fire resistant rating
- d) Storage of waste fluids to comply with Manitoba regulations
- e) No more than 4 semi-trucks are to be stored on the property at any time
- f) No accumulation of derelict vehicles at any time
- g) any future expansion requires approval by Council.
16/174 Pegoski – Porrok
Whereas the Rural Municipality of Rosedale has been approved for cost-shared funding under the Clean Water and Wastewater Fund (CWWF) for the Rosedale Rural Waterline Expansion project as identified in our 5 year capital plan and;
Whereas the Rosedale Rural Waterline Expansion project has been approved in the amount of $3,000,000.00 (Three Million Dollars);
Whereas this project could not proceed in 2016 without the CWWF funding;
Whereas the Rural Municipality of Rosedale attests that this project can be completed by March 31, 2018;
Therefore Be It Resolved that the Rural Municipality of Rosedale proceeds with the project at their portioned cost of $750,000.00 (Seven Hundred and Fifty Thousand Dollars);
And Be It Further Resolved that the Manitoba Water Services Board be authorized to provide Project Management Services to the Municipality for the tendering and construction of the Rosedale Rural Waterline Expansion project.

That we authorize Kara Sylvester, CAO to attend the MMAA course to be held in Winnipeg September 8, 2016 and that all allowable expenses be paid.
16/176 Porrok – Scott
Whereas the Town of Neepawa, the R M of Rosedale, the former R M of Langford, the former R M of Lansdowne and the former R M of Glenella met on August 6, 2014 to proceed with binding arbitration regarding tax sharing of the ambulance facility,
And whereas prior to the commencement of the arbitration hearing, the Town of Neepawa made an offer to the municipalities to retroactively share the taxes on the ambulance facility,
And whereas due to elections and amalgamations, this issue had not yet been resolved,
Therefore be it resolved the Council of the Rural Municipality of Rosedale agrees to accept the Town of Neepawa’s proposal dated July 20, 2016 and therefore not proceed with the binding arbitration;
And also be it resolved the Council of the Rural Municipality of Rosedale agree to conclude the terms of the 2014 proposal by sharing tax revenues based on the taxation revenue achieved under the general municipal mill rate and NOT on local improvement and special levies for 2016 and forward.

The Council of the Rural Municipality of Rosedale has agreed to grant the Neepawa Centennial Project $2500.00 to assist with their 2016 capital renovations.
16/178 Kostenchuk – Scott
That We the Council of the Rural Municipality of Rosedale approve the proposed subdivision by Michael R. Kulbacki on NE 1-16-16 WPM providing the following conditions are met:
- THAT a Conditional Use Order be granted allowing for the non-farm, single-family dwellings within the “AG80” Zone.

That the Council of the Rural Municipality of Rosedale has agreed to grant the Kelwood Playground Wellness Committee $500.00 in return for clean-up of the Kelwood Landfill which took place in May, 2016.
